When asked if considering the use of Gen AI, most respondents answered either Don't Know (30) or No (36). Of those responding, 38 said they were considering the use of Gen AI to assist with litigation support functions. When asked what types of functions respondents would use Gen AI on the use case mentioned most was summarization with the creation of chronologies following closely behind. It's interesting to see what functions and features software developers are currently incorporating into eDiscovery and practice support tools to understand where the use cases are headed. The following are only a few examples of tools incorporating Gen AI. Relativity AiR Relativity is working on making document review faster whereby you submit a subset of records (given the cost of tokenization) to the model following which it will generate output in fields listing a citation containing five sentences of text, the rationale as to why the prediction is right, and considerations as to what information would make the prediction wrong. The model will return responsive documents based on a description from the user and in turn, the user provides feedback to fine-tune the results. Disco's Cecilia You can ask Cecilia questions and it will provide evidence-based answers with citations to the documents in a database. Questions are in plain English. In response, you will receive a list of sources with snippets from the records in the order that may be helpful. Everlaw AI Assistant You can obtain insights at the document and narrative level with links to the sources. It will provide quick summaries of large documents and you can ask questions about a particular document. It will create a factual analysis narrative, a statement of facts based on the documents, and a narrative timeline. Casetext CoCounsel (Thomson Reuters) You can upload a database and ask questions, have it summarize and interpret a document, provide you with a legal research memo with links to on-point cases, and assist with the preparation for depositions by generating on-point topics and questions. The incorporation of Gen AI into eDiscovery and Practice Support tools is only in the very early stages. While there are many hurdles to overcome, the future looks bright. Gen AI will become another tool in the arsenal of the eDiscovery professional to tackle the ever-growing volume of electronic evidence. ILTA
