Many change initiatives are likely to fail. • Pay more attention to legal contracting before the event than after the event. Uncommon Sense are smart things not being done by others. Too many times, teams are afraid to lean into a very different idea of how-to problem solve as it may have not been done before. However, the risk of that new innovative solution could pay off with cost reductions for the legal team and overall company. Examples of Uncommon Sense include: • Reviewing existing processes before any major changes e.g., introduction of new technologies, changes in ways of working etc. • Learning from the experiences of other functions e.g., those that do a better job of managing and analyzing their data (Finance or IT), those that have successfully embedded digital transformation for operational processes (HR). • Align business case and funding for legal tech implementations with revenue generating teams' needs e.g., sales. CLM is not just for legal. • Identifying opportunities to add value with influential departments and stakeholders outside of the core law department. • Paying more attention to what can be learned from departments other than legal and organizations outside of your core sector. Uncommon partnerships can lead to above average performance. • Differentiate between legal, operational, and technical complexity to embed legal operations practices. Common Sense is conventional wisdom that others agree with. This involves leaning into solutions that have low hanging wins. Examples typically rely on the identification of process improvement opportunities within the legal and business teams. • Use of playbooks to support with common scenarios, whether they be to support contract management through templates and canned responses to likely situations. • Triage and delegate specific types of legal request based on complexity / importance / urgency.
