108 AI FOR PRODUCTIVITY VS AI IN REGULATED DECISION WORKFLOWS When evaluating AI in legal environments, it is useful to distinguish between AI used for productivity support and AI used within regulated decision workflows. Productivity AI helps legal professionals work faster. These tools summarize documents, suggest classifications, draft text, or surface potentially relevant material. In these cases, the AI assists the human professional, and the human remains responsible for the final outcome. Many emerging AI capabilities fall into this category. Legal teams are already using AI to accelerate early case assessment, summarize interviews, organize evidence, and speed up document review preparation. Regulated decision workflows, however, operate under a different set of expectations. In these environments, organizations must be able to demonstrate how data was handled, how outcomes were produced, and who approved critical steps in the process. This is where architectural controls become essential. Workflows that support regulated processes must maintain clear system-of-record controls, chain of custody, audit logs, and traceable human approval points. The distinction is not about limiting innovation. It is about ensuring that when AI is introduced into regulated environments, the surrounding systems provide the transparency and accountability required to withstand external scrutiny. THE DEFENSIBILITY GAP: PRODUCTIVITY TOOLS ARE NOT EDISCOVERY SYSTEMS OF RECORD In ediscovery, defensibility hinges on traceability and repeatability across the entire discovery lifecycle. A defensible review requires audit trails detailing who did what and when, controlled processing, quality control evidence, and documentation that can withstand scrutiny. This is precisely why legal productivity plugins and general agent platforms are not ideal for ediscovery defensibility. They often suffer from limited ability to generate court-defensible chain of custody records, incomplete provenance, and unclear boundaries regarding dataset and tool actions. For example, they lack native guarantees of hashing at ingestion, immutable evidence repositories, and production logs tied to formal approval checkpoints. The practical takeaway for corporate legal departments is straightforward. The purpose-built ediscovery platform must remain the authoritative system of record. If AI is used, it must sit inside controlled boundaries where the platform maintains document IDs, review actions, and QC logs. Without explicit checkpoints where humans validate and sign off, AI review becomes automation without accountability. THE RISKS THAT HUMAN OVERSIGHT IS DESIGNED TO CATCH When agents operate autonomously, they introduce unique threat vectors. Agentic systems are exposed to prompt injection attacks when operating on untrusted content, which is exactly the scenario faced in ediscovery with mixed-trust corporate data and third-party productions. We must also account for data leakage and oversharing pathways. An agent with excessive autonomy could inadvertently expose sensitive data during task execution. There are also silent failure modes that go beyond hallucinations. These include overbroad retrieval, misrouting of data, or pulling from the wrong dataset entirely. Most critically for litigation, we face privilege and confidentiality failure modes, including inadvertent disclosure and inconsistent redactions. These are not theoretical risks. They are sanctionable events. Human approval gates are designed to detect context errors, privilege risks, and overreach before they become production failures. Through this lens, Human-in-the-Loop is not about slowing AI down. It is about making AI outcomes provable.
