Working with your professional liability insurer to create mandatory ethics and responsibility training for your firm on Gen AI use might also be worthwhile. Returning to my opening statement about adopting previous "disruptive technology," reassuring clients that the use of Gen AI is no different. This is a logical progression for everyone. Vendors, law firms, and corporate legal departments are all exploring, having conversations, and getting comfortable with new technologies they can implement in their daily practice. Sailing Away Building trust in Gen AI tools is the most significant obstacle for firms seeking to move from the shore (experimentation stage) to the boat (widespread Gen AI adoption). Less than half (40%) of the attorneys we surveyed trust Gen AI for legal work. While there is always an inherent risk to every new legal technology we use, perhaps we don't need to reach 100% acceptance. Instead, as AWS Associate General Counsel Justin Grad quipped, we might only need to get an "acceptable tolerance level." Adequate training and education, strong data privacy and security, ethical guidelines and guardrails, and transparent and accurate results are the pillars of trust in Gen AI. By taking these steps, law firms and clients can ensure that everyone gets a comfortable seat on the AI boat before it sails too far out to sea.
