Establishing comprehensive governance programs as early as possible can help you efficiently respond to a high-stakes investigation. Follow the Data Finding the data is only the first step. During your review, it's critical to monitor everything data service providers compile daily. Although that might seem like busy work, avoiding errors during a review is essential. Careful tracking provides insight into your team's progress, responsiveness, thoroughness, and spending levels. Monitoring the data also allows you to assess and change priorities during the review. Protect the Data Dealing with the overwhelming task of trying to respond to an antitrust review, targeted companies often fail to carefully vet their providers – opening the door to critical errors at the worst possible time. A thorough provider assessment should include: • A review of the track record. Talk with the provider's previous customers to learn how well the provider met expectations and budgets, and if the overall experience was positive. Look for exceptional service, not just acceptable service. • An understanding of the experience. Has the provider handled customers like yours in size and that operate in your industry? Investigations vary in scope. It is critical that your providers understand the specific issues that might affect your review. • A demand for customization throughout the project. Does the provider offer a one-size-fits-all approach, or does it tailor its project plan to each customer? If the provider fails to investigate how the customer's organization works and what its short- and long- term goals are in addition to the case goals, that provider might overlook critical information during the review process. You can't count any errors in antitrust investigations, no matter how small. By implementing a process that includes an up-to-date information governance plan, a data service provider that acts as a true partner, and vendors that generate the highest level of customer success, you can ensure that your organization will meet any antitrust investigation with the most substantial possible response.
