All of these topics can translate well to structured classes or just-in-time training — it is 'just' a matter of getting the case teams' time and attention. While there is significant movement in other areas, the discovery services routinely performed in house remain stable with Processing and non- forensic collection as the notable services with focus in law firms. Charging for services remains consistent with per hour for all services other than data hosting / file storage where applicable. Additionally, outsourcing remains at the matter level, which is common. Where other arrangements are made for managed services by client - those are not reported in this survey (this was also not a focus in designing survey questions – but we continue to appreciate the data point that this question provides). We continue to be engaged in learning how service providers are selected and the answers provided are helpful to gauge how law firms are evaluating providers. Other than the response of 'No Answer', the top three responses received similar votes: • Cost | Pricing Model leads the responses • Past Experience | Relationship | Reputation • Quality | Skill of Provider | Reliability This is telling for the state of the industry and is not surprising – litigation is not an area to experiment unless there is a great reason that relates to the proportionality of the discovery spend and/ or the type of data encountered. Where litigation support seeks predictability and consistency – those responses make sense. Challenges - between data sizes and sources, the trials and tribulations of litigation support continue. While we strive to maintain consistent processes and defensible methods – emerging data sources are the greatest 2022 challenges. I have a had more interviews with service providers for both our in-house application and outsourcing opportunities than ever before – all around how emerging data is handled for processing, review and production.
