Vendors that are significant partners with a firm may have to go through annual reviews to ensure they are in good standing. But in addition to audits, insuring a tight security posture, requires active engagement with the vendor, its security personnel and your own InfoSec and governance team. Greg Chan, Cybersecurity Manager at Paul Hastings, noted that outside counsel guidelines (OCGs) continue to evolve, setting the tone for security expected with the firms holding their data. A firm's vendors are expected to comply with the same security bar set by a firm's clients. It is a best practice and an ongoing one to review the toughest OCGs and keep those in mind as you evaluate your vendors. Where Do We Go From Here? With the increased number of cybersecurity attacks on eDiscovery vendors, practitioners have a distinct responsibility to actively validate the security posture of the vendors who have access to our sensitive data. Educating yourself and working with subject-matter experts to design and implement security best practices is essential. ILTA Joan Washburn is the Director of eDiscovery Services for Holland & Knight LLP out of its Boston office. Christopher Acosta is the Head of Firmwide e-Discovery Resources at Morrison Foerster in Los Angeles. He consults with the firm's litigation practice groups and their clients on technical and strategic issues regarding electronic discovery, information governance, innovation, and efficiencies in legal project management. He is responsible for the firmwide coordination and promotion of electronic discovery technology, strategy, and workf low. Chris serves on several committees, such as the Planning Committee of Relativity User Group LA Chapter, Executive Committee of the ACEDS LA Chapter, and ILTA Content Committees. Chris has been a guest speaker on several panels, roundtables, and webinars throughout the country, as well as published several articles on eDiscovery.
