LITIGATION AND PRACTICE SUPPORT 9 WWW.ILTANET.ORG | ILTA WHITE PAPER And the Survey Says: Trends and Topics in Litigation Support by Cindy MacBean of Wa, Tieder, Hoffar & Fitzgerald, LLP When ILTA's litigation and practice support (LPS) volunteer leaders discussed the annual Technology Survey, there was agreement that the value of metrics in the litigation support community has continued to rise, which meant it was time to consider an independent litigation support technology survey. The team gathered to refresh the survey questions and develop new topics. The goal in establishing this survey was to balance historical information with new data. There are areas where trends are not yet established, but they set the tone for future information. The other meaningful change in how we conducted the survey was that we asked each firm's primary contact to forward the survey to the person most qualified to respond. In prior years, the survey was answered as part of the larger technology survey. The new content in the survey addressed the structure of litigation support, staffing, the value of certifications, how services are delivered to the firm, pricing models for litigation support services, and technology tools for collection, capture and preservation. The survey also touched on privacy requirements for transferring data outside the firm and social media — both topics have been in-demand educational topics the past year. Overall, the survey shows a small percentage of early adopters of litigation support technologies. Regarding the pricing model utilized by participating firms, the survey shows that the hourly model leads, with unit pricing as a small percentage. This aligns with a recent ILTA teleforum that discussed the pricing models utilized by most firms. Based on the survey results, there does not seem to be a market disruption or unexpected events.
