ILTA SURVEY: DECEMBER 2015 W W W.ILTANET.ORG 2 INTRODUCTION Litigation support is an evolving and changing part of the legal community, and this year's survey provides a wealth of insight on the developments in this area. The survey also looks at the makeup and training of employees and how an organization bills for its services. The interesting takeaway is that almost half of the organizations responding offer training for certifications, which demonstrates a commitment to provide clients with the best-trained staff possible and employees with the resources to do their jobs well. Looking at data hosting, 49% of respondents indicated they do not charge for hosting and storage in-house. In a time when data volumes are growing exponentially, it will be interesting to see if this trend can be maintained in the coming years. The programs used for early case assessment, processing and hosting represent all of the names we are familiar with: CaseLogistix, LAW PreDiscovery, Relativity, Sanction and Trial Director, to name a few. While there are a lot of great products out there, a third of organizations rely on Microso PowerPoint for litigation needs, which demonstrates that Microso Office skills can be a powerful tool for litigation support groups. An interesting program being used to collect social media data is Adobe Acrobat Professional, with over half of respondents using it. With data sizes growing and the number of social media avenues increasing, it will be interesting to see how organizations address these growing volumes and concerns about preserving metadata from social media. Looking at the phases of e-discovery, it is clear that many organizations are handling components of e-discovery in-house for at least part of their litigation. The one notable exception is collection, where many organizations outsource this to a third-party vendor. This makes sense, as the person(s) collecting the data can be called as witnesses at trial. For third-party services organizations overwhelmingly want a vendor that provides an all-in-one model that streamlines the process for all parties involved. A majority of organizations are utilizing email threading and near- duplicate identification to save time and money on projects. In addition, 41% of organizations use computer-assisted review technology, which is a trend likely to continue to grow as the volume of data grows. This will ensure projects are managed in an efficient and cost-effective manner. The survey also addresses issues of mobile phone data collection and security, among other trending practices that show how the legal community is adapting to the new challenges that arise in the world of e-discovery.
