ILTA WHITE PAPER: APRIL 2015 WWW.ILTANET.ORG 19 About the Author Sean Monahan, Conflicts Counsel at Foster Pepper PLLC, advises the firm on legal ethics and related compliance matters. An attorney licensed in Washington, he also manages the conflicts and records departments, including intake, client engagements, ethical screens and file-closing. Sean serves as ILTA's co-RML for the Seattle region and is a member of the Information Governance Peer Group Steering Committee. Contact him at monas@foster.com. Legal Ethics and Information Governance Every physical digital repository is searched, and the key document is found just in time. A client relations disaster was averted, but did the lawyer also avoid a potential ethical violation? The mechanics of receiving, creating, categorizing, organizing, archiving, destroying and transferring the client file continue to evolve rapidly as lawyers adopt new technology to improve client service. An associate is desperately looking for a critical piece of information, a communication with a client, and there is no record of the document in the physical file or document management system.
