What advice do you have for individuals or firms apprehensive about using
computer-assisted review?
Jessica: Start small! The best way to understand any new review technology is to
employ it on an actual case. It is hard to grasp how the technology works until you
try it, so find a smaller case or one with a more forgiving timeline and use that
as a test run. Find a vendor willing to do some hand-holding to make sure you
are taking advantage of everything the tool has to offer. The biggest mistake case
teams make with technology is not taking the time to get to know the tool they
have.
Jeanette: There is great value to be found in computer-assisted review. It is
worth it to lift the veil and educate oneself on the various features, benefits
and potential pitfalls and limitations of any given software. TAR is just another
way to get to know your data set, albeit a more accurate and efficient way than
traditional manual review.
A BALANCED APPROACH
As knowledgeable users agree, utilizing predictive coding and analytical
techniques to cull down a document corpus and reduce costs can provide
significant benefits in e-discovery. However, informed human interaction is
still required to use the technology effectively and guide legal teams through
executing a well-thought-out plan. Legal teams should develop an ROI and
performance matrix to determine whether predictive coding is a cost-effective
solution for each particular matter. There are benefits to using TAR over
traditional review methods, but both have their limitations; there is no such thing
as a perfect solution.
