Only just over 10% are "getting it". • Nearly 75% of respondents haven't outsourced the traditional records function, nor have they successfully transitioned a records employee to an IG employee. Only 24% have created IG roles and hired into those roles from outside the records department. • While 72% of respondents indicated that have an active disposition program, 63% still exempt executives/partners from Information Governance requirements. For the 37% who do not permit exceptions, thank you! • Only 52% of firms are actually completing thorough/defensible records destruction by destroying both paper and electronic records. In my experience, many lawyers think that only paper records should be destroyed. • Most firms have a retention policy (82%), but only 16% of firms have software to manage retention. • Of the 48% of firms that have a Matter Mobility function, only 14% think it's "very mature," and only 28% have teams dedicated to support matter mobility functions. I think that shows that it's generally considered to be important, but we still have a long way to go. • A data map is considered a foundational requirement of an IG program, yet 54% of respondents do not have a data map or at least some documentation detailing where all of their content resides and who the functional owner is of the repository/system. • A full 80% of respondents are conducting security awareness programs, and 66% incorporate IG into new hire and/or technolo training. In most cases (58%) training is mandatory. Interestingly, the majority of respondents (74%) believe they are changing behaviors, but less than half (44%) are monitoring compliance. Overall I believe the survey presents an interesting point in time snapshot of how - and what - our industry is doing to ensure compliance with information security frameworks, ethical requirements to preserve information, regulatory requirements (HIPAA, GDPR, CCPA, etc.) and client requirements. I'm hopeful that with continued education and awareness we will be able to see significant increases in many firms' IG programs.
